Whether it is a newly built home to a 17th century farmhouse, a city centre apartment to coach house, we have come across all forms of property, be it freehold or leasehold and will be familiar with their nuances. You will have a designated lawyer to guide you through the transaction and you will receive a tailored and efficient service. You will be able to speak to and contact Eccles Heddon for regular updates and answer any queries you may have. In a typical purchase, we would normally do the following work as standard: - We will advise you of any SDLT (Stamp Duty) liabilities associated with your proposed purchase from the outset. Review the initial contract papers received from the Seller’s Solicitor. This would include amending the sale agreement, a comprehensive review of the property’s title and review of any other forms and documents that may have been disclosed. Once a plan of the property is to hand, we will submit any required searches on the property (for instance, a Local Authority Search, Drainage and Water Enquiries and Environmental Search). We will provide a comprehensive report to you on the initial documentation that has been disclosed. Where appropriate, we will raise additional enquiries with the seller’s solicitor, keeping you informed of the responses that are subsequently received. Prepare the necessary SDLT Forms and Transfer Deeds. Attend to the necessary exchange of contracts and the subsequent completion. Selling property is often perceived as a stressful and daunting process. Once a buyer has been found, we will send the contract papers over to the buyer’s solicitor. Request a redemption statement from your lender. Attend to any additional enquiries raised by the Buyer’s Solicitor, taking your further instruction on specific matters where appropriate. Attend to the exchange of contracts and the subsequent completion. A deed of gift of property is a legal way of documenting a transfer of legal or equitable interest in an asset, such as a property. It is often used to transfer ownership from a parent to child. Once you have taken advice from our Private Client Team and your accountant, we can ensure that any gift is documented by deed and is legally binding.

A Transfer of equity is the legal process of removing or adding someone to the ownership of a property. This will typically be required where you wish to add a new partner or family member to the title or wish to remove someone from the ownership, owing to a divorce. It may also be required where the shares of ownership are changed. There are many potential pitfalls with a transfer of equity (including Stamp Duty) and it is important to seek the advice of a professional. Registration of Land

It is common to see land / property that has been held by a family for generations. With no recent dealings in the land, the legal title may not be ‘registered’ at the Land Registry. By way of background, the Land Registry holds an online register documenting what land is held in whose name up and down the country. Where land is registered, each parcel of land is given its own unique title number. That title will describe the property, show an outline of the boundaries on an up-to-date Ordnance Survey plan, confirm who owns the land (including the full name and address of each legal owner) and where appropriate, detail what rights and encumbrances the land has the benefit of or remains subject to. Where land remains unregistered, there is a gap in the Land Registry’s records and unless you own the land in question and have retained your title deeds, it can be very difficult indeed to establish the boundaries of a title and who the current owner is. There are other advantages too, including helping ensure a property can be sold without title complication, to helping combat a squatters claim of ownership via adverse possession. Mortgages/Re-finance

We are on the panels of many banks and act regularly in the refinance of property, whether it is on behalf of the bank or borrower. We know how lenders operate, how best to communicate with them and most importantly, what issues are critical to them. There might be fundamental issues with a property (such a flying freehold) that we know is unacceptable to a particular bank, and we can pick up on such points with you from the outset before incurring substantial cost. There are differences between each bank's lending criteria and individual requirements need to be read and understood by your solicitor from the outset (for instance, are property searches required and will this have a bearing on any intended completion date you have in mind).
