Relationship Breakdown

When relationships break down there are usually many practical and legal questions on which you may need advice. We can help.

We have family lawyers at our Ripon and Bedale offices who will discuss matters with you, whether your relationship has irretrievably broken down, or whether you are considering the consequences of a possible separation and are looking for preliminary advice. You may have concerns of a financial nature, or in relation to the future of your children. Our family team will offer sensitive and practical advice with the intention of helping you to move forward.

We will try to avoid lengthy and potentially costly court proceedings wherever possible. By taking a conciliatory and constructive approach to family matters, many issues can often be resolved amicably and without the expense of going to court. However, in those cases where court proceedings are regrettably required, we will guide you through the process, and always work with you to achieve a satisfactory settlement as early as possible.

Upon receiving your initial instructions, we will give an indication of our fees. By their nature, it is often hard to predict the way in which matrimonial cases will evolve, so we will explain the costs which could be involved in various different circumstances. You can, of course, ask at any time for an update as to the costs which have been incurred and we will always check with you before exceeding any agreed limit. We are unable to offer publicly funded (legal aid) work.

At Eccles Heddon, when you ask for advice regarding the breakdown of a relationship, our primary role is to look after your interests and to minimise the anxiety of difficult circumstances.

Children

Children are usually the most important concern for any responsible parent.

During or following the breakdown of a family relationship the care of any children and consideration of their emotions and wellbeing are paramount. Our family lawyers are experienced in dealing with contact and residence issues and will work with you to ensure that both you and your children are as happy as possible with the arrangements which are in place for their care.

As with matrimonial matters, we will always try to reach an amicable solution, so avoiding the cost and anxiety of court proceedings. However, where this proves impossible, we will explain the potential implications of court proceedings to you so that you are fully prepared for what may lie ahead. We will always try to achieve a fair and positive outcome which is, above all, in the best interests of your children.

We are unable to offer publicly funded work, but we will give as clearly as possible an indication of the costs which may be involved in carrying out your instructions. However, as with matrimonial proceedings, this is a difficult area to predict and it may be that we will need to agree with you an appropriate limit on costs. This limit will not be exceeded without your agreement.
